Policy Terms and Conditions
Definitions
The following words and phrases are shown in Italics throughout this certificate; their meanings are shown after them:
family - you, your spouse, partner, children or parents who permanently live in your home.
Gems TV - Gems TV (UK) Ltd, Eagle Road, Redditch, B98 9HF
insured goods - the item you have purchased from Gems TV and for which the Jewellery and Watch Cover was purchased.
maximum liability - the price you paid for your insured goods as specified in your certificate of insurance. The maximum liability cannot exceed £2,000.
our - belonging to us.
replace, replacement - The issue of electronic vouchers, to the maximum liability value, redeemable against future purchases from Gems TV.
UK - Great Britain, Northern Ireland, the Channel Islands and the Isle of Man.
we, us - Assurant General Insurance Limited (a member company of Assurant Solutions).
you - the person named on the schedule.
your - belonging to you.
What is insured
We will repair or replace the insured goods in the event of:
- Accidental Damage providing that there is visible evidence that an external force has been applied.
- Theft provided force has been used to enter or exit.
- Robbery.
- Standard perils, damage or destruction caused directly
by:
- Storm, flood, lightning, earthquake, fire, smoke or explosion.
This insurance provides worldwide cover for your insured goods.
Policy Conditions
- It is a condition of this policy that the required premium has been paid for the insured goods.
- To be protected under this policy you must be over 18 years of age.
- You must take all reasonable steps to protect your property and prevent theft, robbery or damage.
- If a claim is fraudulent, fraud is suspected in any respect, or any false information is supplied in relation to any claim, all benefits under this policy will be forfeited and you may be liable to criminal prosecution.
- When you make a claim you must give us all the evidence and documentation that we need to prove your claim. You will have to pay any cost involved in doing this. You must give us this evidence in the way we ask.
- We will repair or replace your insured goods to the maximum liability specified in your certificate of insurance.
- Where a claim is settled by complete replacement of the insured goods, your policy will expire upon completion of the claim.
- If you wish to have your replacement goods insured you must purchase a new Jewellery and Watch Cover policy.
- You may cancel Jewellery and Watch Cover within the first 30 days by giving Gems TV notice in writing, or by returning the original certificate to Gems TV. Providing no claims have been made, a full refund of the original premium will be given. After the initial 30-day period, no refund is available.
The terms and conditions of this cover do not affect your statutory rights relating to faulty or mis-described goods. For further information about your statutory rights, contact your local authority Trading Standards Department or Citizens Advice Bureau.
Law Applicable to Contract
Under the relevant European Community and UK legal provisions you can choose which law covers this insurance, but unless we agree otherwise, English law will apply.
Gems TV offer this cover as agents for Assurant General Insurance Limited, incorporated in England no 2341082, whose registered address is: 117-119 Whitby Road, Slough, Berkshire, SL1 3DR.
Claims
To make a claim please telephone us on (0844 871 1215) for advice on how to proceed. All claims must be made within 30 days of the incident. Failure to do so may invalidate your claim.
For repairs due to accidental damage of the insured goods, you must return the insured goods to our authorised repairer.
You must notify the Police within 24 hours of any theft, robbery, vandalism, malicious act or fire and obtain written confirmation, which will include a crime reference number and station telephone number, or in the case of fire, a fire reference number. These numbers MUST be provided for your claim to be successful. A copy of the crime report may be required to confirm the circumstances of your claim.
What is not insured
1. You can not make a theft or robbery claim:
- If the insured goods are stolen from a motor vehicle, unless the vehicle is locked at all points of access and all the security systems are activated and the insured goods are concealed in the locked boot or locked glove compartment;
- If the insured goods are left at your place of work, school, or any public place, unless locked in a secure locker, safe or similar lockable compartment to which you have sole access;
- Where any incident of theft, robbery, vandalism or malicious act is not reported to the Police within 24hrs of the incident taking place;
- For any incident of theft where force is not used to enter or exit;
- If the insured goods have mysteriously disappeared or if the insured goods have been lost.
2. You can not make a claim for theft, damage or destruction caused by or arising from:
- normal wear and tear, denting, scratching or any gradually operating cause;
- any process of cleaning, restoration or alteration;
- not following the manufacturer's operating instructions or overwinding;
- damage caused by or during the execution of any criminal act by you;
- malicious damage or theft caused by you, your family or any person lawfully on your premises;
- malicious damage or theft from your premises where they have been left unoccupied for a period of more than 45 consecutive days;
- any consequential loss;

Complaints Procedure
Although we set ourselves high standards, if we do not meet your expectations and you are not satisfied in some way we would like to know. If you follow the guidelines below, your complaint will be dealt with in the most efficient way possible.

Step 2 - If you are still not satisfied with the way your complaint has been dealt with, you can ask the Financial Ombudsman Service to review your case. You can contact him at the following address: South Quay Plaza, 183 Marsh Wall, London, E14 9SR. Telephone Number: 0845 080 1800.
In order for the Financial Ombudsman Service to review your case, you must send your complaint to them within 6 months of our final correspondence to you.
Assignment
The benefits of this contract may not be assigned to a third party.
Notice to Customers
You are advised that any telephone calls made to our administration and claims handling units may be monitored or recorded. This is to monitor the accuracy of information provided by our customers and our own staff. It may also be used to provide additional training to our staff or to prove that our procedures comply with legal requirements. Our staff are aware that conversations can be monitored and recorded.

If we are unable to meet our liabilities, you may be entitled to compensation from the Financial Services Compensation Scheme (FSCS) who can be contacted at: 7th floor Lloyds Chambers, Portsoken Street, London, E1 8BN.The first £2,000 of an insurance claim or policy is covered in full through the FSCS, plus 90% of the balance.

Privacy Statement
We are a registered data controller under the Data Protection Act 1998. We are joint data controllers, with Gems TV, of the personal data that you provide. As required by the Data Protection Act 1998, we follow strict security procedures in the storage and disclosure of information, which you have given us, to prevent unauthorised access.
Personal Data
Protecting your privacy is important to us. To the extent that personal data or sensitive personal data is processed about you, we will employ appropriate security measures given the nature of the data. We shall try to ensure that your details are accurate, kept up to date and we will not keep your data for longer than is necessary.
Use of Your personal data
The information you supply will be used (i) to administer and process your insurance policy, (ii) to keep you informed of changes to insurance products you bought, (iii) for internal analysis and research, and (iv) to identify you when you contact us.
Sharing of Information
We will not disclose your personal information without your consent, except in limited circumstances as permitted or required by law. We may share your personal information with third party service providers in connection with providing, administering and servicing your insurance policy.
Your Right to Access
You have the right to access the personal data that we hold about you, by sending a written request to us at Assurant General Insurance Limited, 117-119 Whitby Road, Slough, Berkshire, SL1 3DR, and on payment of a fee of £10.00. You also have the right to request we correct any inaccuracies in the information we hold about you.
